1. Who these terms are with
This website is operated by Proper Express, a subsidiary of Proper Logistics Private Limited (CIN U51201CT2024PTC016500), Behind Nutan Rice Mill, Telghani Naka, Raipur, Chhattisgarh 492001. In these terms, "we" and "us" mean that company; "you" means the person or business using the site.
By using this website or holding an account with us, you accept these terms. If you do not accept them, please do not use the service.
2. Your account
- You must give accurate registration details and keep them current. GSTIN and PAN, where supplied, must be your own and valid, because they appear on tax invoices we issue.
- You are responsible for your password and for everything done through your account. Tell us immediately if you suspect someone else has access.
- One account per person or business. Do not share credentials.
- We may suspend or close an account that is used for fraud, for unlawful consignments, or in breach of these terms. We record login, logout and failed sign-in attempts for this purpose.
3. Booking through the website
A booking made online is a request to carry goods. It becomes binding on us when we accept the consignment into our custody, not when the form is submitted. We may decline a booking, including after it is placed, where the goods are restricted, wrongly declared, unsuitably packed, or the route is not serviceable.
You are responsible for the accuracy of everything you enter: addresses, contact numbers, weight, dimensions, contents and declared value. Charges are calculated from the chargeable weight, which is the greater of actual and volumetric weight.
4. Charges and payment
- Rates depend on route, chargeable weight and the service mode you select, and are shown to you before you confirm a booking.
- Charges are exclusive of GST unless stated otherwise. GST is applied at the prevailing rate.
- Where you pay from your wallet, the amount is debited when the booking is confirmed and the transaction is recorded in your transaction history.
- Credit accounts, where granted, are subject to the limit and payment period agreed with you. Overdue balances may lead to suspension of credit facilities.
- Storage beyond the free days included with a booking is charged at the applicable daily rate.
5. Wallet
Wallet balances are a prepayment against freight charges with us. They are not a deposit, earn no interest, and are usable only for our services. Refunds of an unused balance are handled case by case and may require identity verification.
6. Tracking information
Tracking is provided for your convenience. Statuses are updated by our staff as a consignment moves and may lag actual events. Estimated delivery dates are estimates, not guarantees, and can be affected by weather, road conditions, strikes, regulatory checks and other matters outside our control.
7. Acceptable use of this website
You agree not to:
- scrape, crawl or bulk-query the tracking system, or attempt to bypass its rate limits;
- try to access accounts, data or areas of the system that are not yours;
- probe, scan or test the security of the site, or interfere with its operation;
- upload anything malicious, or use the site to send unsolicited messages;
- reproduce substantial parts of the site for a competing service.
8. Intellectual property
The Proper Express name, logo, site design, text and images belong to us or our licensors. You may view and print pages for your own use in dealing with us. Any other reproduction needs our written permission.
9. Availability
We try to keep the site available but do not guarantee uninterrupted access. We may suspend it for maintenance, and may change or withdraw features. Where the website is unavailable, bookings can still be made at any branch.
10. Liability
Our liability for the goods we carry is dealt with in our booking rules, and is subject to the limits stated there.
For the website itself, we are not liable for indirect or consequential loss, or for loss of profit, business or data, arising from its use or unavailability. Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Third-party links
Where we link to other websites, we do not control them and are not responsible for their content or their handling of your data.
12. Privacy
Our handling of personal data is described in our privacy policy, which forms part of these terms.
13. Changes
We may update these terms. The version published here applies to your use of the site from the date shown at the top. Continued use after a change means you accept the revised terms.
14. Governing law
These terms are governed by the laws of India. The courts at Raipur, Chhattisgarh have exclusive jurisdiction over any dispute arising from them.
